Suing over something like that is silly, so i'm glad you choose not to... But you're allowed to beat the guy blocking your path (Just joking, of course ).

Well, as the others said, the waiver won't do a whole lot legally, but it's a good idea... But so is insurance as well

I think the idea is you're supposed to fall ON the guy who made you fall. Let him take the impact.

If you've missed that window of opportunity, then the rest doesn't much matter.
