I Hope That His Lawyer Is Paid By The Hour
"Matthew Fencl was riding the vehicle in June 2006 near 16th and State Streets when he brushed up against a building and the two-wheel transporter violently turned, causing him to fall off, according to a lawsuit filed Thursday in Cook County Circuit Court.
The suit said that the company issued a recall the following September on certain models of the Segway, saying the vehicles could unexpectedly reverse direction and cause riders to fall." Let me get this straight: he admits that he brushed up against the wall. So it WASN'T that the Segway suddenly decided to spin around all by itself, it was the fact that he hit the wall with his wheel. Which is warned against in training, and if you weren't warned about that in training, THAT is who he should be mad at, not Segway!

In every instance of a one person crash...it's always been operator error. Speed, hotdogging, following to close, not paying attention or exhaustion from a long ride.

when you really look at it, no one knows exactly what happened other than the few comments in the article. we all know that when one wheel gets hung up or blocked or otherwise prevented from turning, more torque seems to go to the other wheel and that is when strange things can happen, sometimes catastrophic. I've always wondered if the electronics could not detect if a wheel was obstructed, and then shut off without additional torque being seemingly applied to the unblocked wheel.
segway continues to use the wording: RISK OF DEATH OR SERIOUS INJURY Whenever you ride the Segway PT, you risk death or serious injury from loss of control, collisions, and falls. To reduce risk of injury, you must read and follow all instructions and warnings in the User Materials. all of us, during the first week of use, at times became over confident and in some cases, got hurt. even after 5 years of use, we can become complacent. unfortunately, a reported accident, injury or death, negates the safe operation of thousands. __________________

That's usually the case regardless of what you are riding or driving. The machine is rarely at fault.

I'd bet the machine is NEVER at fault
Remember the balancing technology and dual redundancy of everything came out of the ibot.
Even the 'bug' that the recall was for, would have to be user induced by riding it WAAAY outside of specs.

This is so opportunistic it's sickening. Does the manufacturer get sued if:
-You hit a pebble with your skateboard and fall off? -You catch a rollerblade on a curb and trip? -You bump your bike handlebar or pedal on something and fall off? -You catch a ski on a mogul and fall down? -You trip over your shoelace and fall down? -You flip your ATV and fall off? Hitting walls has nothing to do with any basis for either Segway recall... |
