Great thread. Be careful not to take a Gen2 on an aircraft as it will be banned if discovered and the only fool-proof solution for the airlines is to ban all Segways. I love traveling with my Segway and chose a Gen1 specifically to be allowed on airlines.

Default Catch 22: You can Buy them, They can't Sell them.

The current irony is that you can buy yourself a Segway and as of March 15 it will magically become an "Other Power-Driven Mobility Device" under the ADA and you will be able to take it most places as your mobility device of choice. Folks like Simon's Malls who currently ban them, "because", will have to prove that the Segway use by handicapped people is a real hazard to their operations in order to ban them - a much tougher standard.

However, Segway Inc. can't sell it to you as an "Other Power-Driven Mobility Device" under the ADA because that implies it has a medical use, therefore it needs medical device approval, and under the current FDA regulations a powered scooter or wheel chair needs at least 3 wheels - and there is no other category for the Segway that I can find.

So, you can buy and use it under the ADA, but, no one who sells Segways can suggest that you might find them useful, because if they do they are probably in violation of FDA rules.

Which is why SegSaddles are only sold to dealers in the USA.

Default Not Sold outside of the US you say,

I live in Canada and last year my dealer in Gatineau Quebec purchased one from you and installed the new Segsaddle on my I2....I love it, but I dont understand what you are saying about not selling outside of the US

Its not that only USA gets the seats. Is it that only DEALERS get the seats. Get it?

I'm delighted to hear that the SegSaddle works for you Bruneje. Please take the time to register on the SegSaddle website so I can keep you posted with the current manual, etc.

A number of Canadians have suggested that I move SegSaddle to Canada so I can promote the product in a way that reflects how it is actually being used. Also, we've sold units all around the world, as far away as New Zealand and Australia. About half our sales are international and I know that almost all of them are to people with mobility limitations that the SegSaddle equipped Segway mitigates.

In the USA I sell only thru dealers so I have no idea who the end users are.

The Segway was designed to be the ultimate personal mobility device so I assume Dealers sell them as mobility devices.............not as an "other power-driven mobility device". My personal experience with Segway dealers is that policy set by Segway, Inc. does not allow them to sell or promote the Segway as an other power-driven mobility device from a Medical needs perspective for liability reasons (Fear of Segway,Inc.). They certainly should be within their rights to quote ADA rules and regs on how or where a customer can ride the Segway after their purchase without fear from the law. It's should be easier now to use them with the appropriate placard in public and private places thanks to the new ADA ruling.

I don't think the FDA cares unless a doc is writing a Rx for a Segway that implies medical use to be reimbursed by Insurance companies and Medicare.

Correct.
Nowhere in the ADA does it state a device must be FDA approved to be protected.

Now as far as the new regulations. March 15, 2011 will not be a panacea for Segway users. Most will be unaware of the new laws and some just won't care.

Others will chose to challenge the regulations. Guess who ?

The fact is that many of the problems that the ADA was intended to fix in 1990 still haven't come to be. Over the years the courts picked apart the ADA hence the Restoration Act.

Not looking to ruin the party but don't expect the doors to fly open, be ready and know your rights.
