I am thinking of registering a domain name with the word "Segway" in it. Has Segway LLC ever sent a cease and desist letter to Segwaychat.com, or any "Segway*.com" website? I would put a disclaimer stating that, "We are in no way related to Segway LLC at http://www.segway.com." at the top of my website, but I would really like this domain name. What would you say? Thanks!

I will do almost anything to get a Segway!

I've seen domain names being sold on ebay, you can check there.

I suggest you familiarize yourself with the trademark use guidelines found on the LLC site: http://www.segway.com/aboutus/trademarks.html My suggestion is not to use anyone's trademark in your business or personal use. Why open yourself up to legal action when it's so easily avoided? Be creative, make your own name up!

Erik,

I think that the only realistic problem you would face using Segway in a domain name is Segway City. He will immediately 'tell on you' to LLC. Especially if he forewarned you, and you do not heed his 'advice'. And hey, you could then tell on him. As he is currently using Segway for his 'personal use' as his chat name.

He says," Be creative, make up your own name." Yeah, like 'SEGWAY' City...

Now, where in #3jj did that come from? Frances piss in your Wheaties?

Segway City,

Do you have permission to use the Wheaties name? You know it is trademarked...

Oh, by the way, I invited my insurance broker to attend SegFest. Competition was never the issue, it was only safety and 'big mouths'...

ROTFLMFAO Man, you can almost smell the booze between the lines....

Having ourselves a little hurricane party, are we?

Your DISRESPECT for the tragedy of this hurricane shows everyone at Segway Chat what kind of a person you REALLY are. Also, hiding behind 'coded' words is a game I played when I was about 10 years old.

I suggest that you READ THE LINES instead of between them. Maybe then you will see the importance of what people are saying. Implying that I might be drinking or drunk only means that you don't have a clue. I'm afraid that your business and personality skills have now lost a lot of credibility on this site...

Maybe you should look for a new chat site for the unimaginitive, I'll bet you could share great Q-Tips. Check the RAD2GO Q-Scooter site. I'll give you a 'glowing' reference...

Nothing can be gained through the furtherance of conversations with those whose minds are closed. Intolerance is an evil that lives within those walls, adeptly nurtured by those who choose to reside within them. I choose not to live that way.

Thank you again for those 'un-original' words of wisdom. We'll leave it at that...

Just an FYI, "Segway" is our registered trademark and use of it *any* domain name is very possibly infringing on that trademark without our expressed permission. Just thought you should know.

There is a voice inside me telling me it would be wise for me to not offer my opinion on this thread. However, I very respectfully submit as passionate supporter of Segway HT products and community that the courts have allowed in very specific limited situations the use of a trademark in a domain name without permission when it has served a descriptive purpose that can not be met with other terminology, and the user has a legitimate interest in that purpose.

I am not going to go any further explaining or debating this, and citing the long list of examples, but I have done extensive research and will point to one well known case. If you go to harleychat.com, it will resolve to a site that has classified ads for used Harley Davidson's. I suggest that it is in the best interest of the Harley Davidson company that this healthy marketplace exists for used Harleys. We have already witnessed many used Segway ebay fiascos. Of course one must understand the trademark and copyright laws, as well as domain name law, in order to make a decision to use a trademark in a domain name and of course John is correct that it is “very possibly infringing” (just not necessarily).

I would hope that by keeping my motives well intentioned, and in the greater interest of the Segway LLC company, Segway HT products, community, culture and marketplace, that I will avoid offending anyone, and if I should so do so inadvertently, it would be addressed in an amicable manner, without lawyers. It is not my intention to violate anyone's rights (in a real economic sense, not just what you can pay a lawyer to argue). The problem in asking for permission is that I could see why it is easier for an organization to say "no" than to give someone a chance to prove they will bring a positive beneficial contribution.

That all said, I wish I had more time to devote to updating my websites, but now I work about 75 hours a week in a new business, and try to find a few minutes here and there for my family. I plan to get back to them and would welcome and consider any offers of assistance or cooperation.

Peace.
