So I'm driving my car downtown and I see two masked men with guns enter a bank...according to your logic I don't call 911 because I am not personally in danger? Take some responsibility!

As you know, one of my best friends owns a VERY LARGE battery distributing company...ships to just about every city, state, police department, EMS, fire department, hospital, and military complex in the country. (I've been embarrassed to ask him if he is in the Fortune 500 but my guess would be yes.)

He shipped the battery for me using his certifications. He also had little "plastic like" piece that his employee screwed onto the contact points of the battery...I assumed that this part of the shipping process, but I didn't ask. Have you ever heard of such a thing?...it had his company name on it and some written notification warning. I saw that you had mentioned something about shipping batteries if attached to the Segway platform...could this be plastic thing--and I'm not sure that it was plastic--be a substitue for isolating and sealing the port opening.

This is also why I doubt that the was SEVER WATER DAMAGE to the battery unless there was a leak in the "silicone-like" sealer that ebattery used to re-seal the battery pack.

If you want to investigate these covers, I'll see if I can get one from IRA the next time I see him.

Back from my evening glide so I am responding to those who commented on my email to MTO.

I agree with most of what you have said...a couple of comments.

I don't know what kind of cells they use (used). Maybe they are the phosphate type that CIVICSMAN asked about.

Calling 911 would seem to be overkill...it was there and it wasn't burning and handn't exploded. I just wanted to charge them and put them to use.

I'm trying to get information. This is pretty much over for me unless ebattery want to go to the next level. Google them for an "eye-full" of complaints. There are plenty of BBB complaints...they don't even bother to respond!

In Joe's defense any battery specialist company knows how lithiums need to be shipped. Shame on them for bypassing the system. DOT goes out of their way to make sure battery companies have information on Hazmat and lithiums have been considered hazmat for a few years now so it is nothing new.

Now that I'm back from my evening glide I'd like to respond to your reply to my post.

If they had sent the original order, and if had worked as promised, without further contact this would have been finished back in December.

You make a excellent product, and although purchased used I've never complained to you, or about you.

My post under the thread "ebattery wants "TRUTH" is exactly what happen without including the dozens of emails that I sent to them asking for help. A very "unresponsive" company. (I could post them, but why waste the effort.)

The final "straw" was their email today requesting a "retraction" of what I had written. I have copies of all of my emails (sometime three or four over a few weeks before they would respond) and all of their responses to my emails...they have usually accepted responsibility without offerring timely corrections of the problems. What they are asking me to "retract" what happened.

I even have saved the telephone messages that they have left me. AND I have a list of many, many calls that I have made to them. I left messages but rarely got responses. (I also have listing of the response calls...all two or three of them!)

In my opinion these guys are A PROBLEM to consumers and I would not recommend using their services. I invite you to Google them and check the complaints with the San Bernardine BBB...WOW!

Sorry if I'm coming off as "A NUT" but I'd like to make sure that other Segway users are not taken in like I was...definitely I was the "fool of all fools"!

I have nothing left to gain from this experience...but maybe, just maybe you can learn from my mistakes.

If there's an emergency, call 911. Otherwise, don't.

If you believe that a shipper not following DOT regulations constitutes an emergency, then by all means call 911.

By the way, in most places, it is illegal to make a call to 911 that's not an emergency. Go for it.

You had a couple of replies to my post. I'm doing responses in reverse order after my evening glide so your first post came up now.

Regarding Florin's axiom: I'm reporting ONLY my opinion of my experience. By doing so I am hoping to save others from "adding to the chain of fools...I accept the title of 'biggest fool'. To Florin, is warning others about the wolf causing the wolf harm?

As I told Jason, I'm sorry if I am coming across as "A NUT", but these guys, in my opinion, have pushed the limit. Google them and check the San Burnadino BBB.

I have nothing to gain from this, but I hope others will consider my opinion when doing business. $1000 + is a lot of money to spend for batteries!

Obviously "NO" to 911...

However, ignorance is not the friend of the consumer.

Mike, (my attorney) called a few minutes ago about dinner tomorrow evening.

Since he was on the telephone I asked him about your statement that there might be a mechanical failure with opening the batteries, he informed me that:

To paraphrase "The defending party must provide to complaintant a full list of all shipments, including the packing invoice, and shippiing price within the period in question including the shipping method and any certificates, such as Haz. Mat., attached. In addition, the defendant must notify all persons persons receiving the questioned shipments within a reasonable period of time."

The suggestion would seem to be that there would be a preponderance of evidence that this method of shipment was a typical practice.

Who cares? I just want this to be done. My opinion, don't use them...Dr. Marty and MTO are the better choice.

I can vouch for both Dr. Marty and Jason as stand up guys. I see no need to look further, personally...

For some reason, I am wondering if they do their battery work in the Philippines. (Just a corny cross reference to another company with highly questionable practices that are selling segway battery restorers 10 at a time, that don't exist)
